Privacy Policy


I. Basic Provisions
  1. The controller of personal data pursuant to Article 4(7) of Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter referred to as the “GDPR”) is Pension Happy – Vladimír Diblíček, Company ID No. 16759028, with its registered office at Děčínská 10/474, 190 00 Prague 9 – Střížkov (hereinafter referred to as the “controller”).

  1. Personal data means any information relating to an identified or identifiable natural person; an identifiable natural person is a natural person who can be identified, directly or indirectly, in particular by reference to a specific identifier, such as a name, identification number, location data, network identifier or one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.
  2. The controller has not appointed a Data Protection Officer.

II. Sources and Categories of Processed Personal Data
  1. The controller processes personal data that you have provided to the controller or personal data obtained by the controller on the basis of fulfilling your order (accommodation reservation).
  2. The controller processes your identification and contact data and the data necessary for the performance of the contract under which the controller provides you with accommodation at Pension Happy.

III. Lawful Basis and Purpose of Personal Data Processing
  1. The lawful basis for processing personal data is:

  • the performance of a contract between you and the controller pursuant to Article 6(1)(b) GDPR.

  1. The purpose of processing personal data is:

  • to process your reservation and to exercise the rights and obligations arising from the contractual relationship between you and the controller based on the accommodation reservation (reservation management, guest records, invoices and payments); when making a reservation, personal data required for its successful processing are requested (name, address and contact details), and the provision of personal data is a necessary requirement for concluding and performing the contract; without the provision of personal data, the contract cannot be concluded or performed by the controller.
  • for marketing purposes and guest satisfaction enquiries, the controller processes personal data (name, telephone number and email address) only on the basis of the guest’s prior voluntary consent.

  1. The controller does not carry out any automated individual decision-making within the meaning of Article 22 GDPR.

IV. Data Retention Period
  1. The controller retains personal data:

  • for the period necessary to exercise the rights and obligations arising from the contractual relationship between you and the controller and to assert claims arising from these contractual relationships (for a period of 15 years from the termination of the contractual relationship).

  1. After the retention period has expired, the controller will delete the personal data.

V. Recipients of Personal Data (Controller’s Subcontractors)
  1. The recipients of personal data are persons:

  • involved in the delivery of goods / services / execution of payments under the contract,
  • providing website operation services.

  1. The controller does not intend to transfer personal data to a third country (a country outside the EU) or to an international organisation.

VI. Your Rights
  1. Under the conditions set out in the GDPR, you have:

  • the right of access to your personal data pursuant to Article 15 GDPR,
  • the right to rectification of personal data pursuant to Article 16 GDPR, or restriction of processing pursuant to Article 18 GDPR,
  • the right to erasure of personal data pursuant to Article 17 GDPR,
  • the right to object to processing pursuant to Article 21 GDPR, and
  • the right to data portability pursuant to Article 20 GDPR.

  1. You also have the right to lodge a complaint with the Office for Personal Data Protection if you believe that your right to personal data protection has been violated.

VII. Conditions of Personal Data Security
  1. The controller declares that it has taken all appropriate technical and organisational measures to secure personal data.
  2. The controller has adopted technical measures to secure data storage and storage of personal data in paper form.
  3. The controller declares that only persons authorised by the controller have access to personal data.

VIII. Final Provisions
  1. By submitting an online reservation through the internet form, you confirm that you are familiar with the privacy policy and that you accept it in full.
  2. The controller is entitled to amend these terms. The controller will publish the new version of the privacy policy on its website and at the same time send the new version of these terms to the email address you have provided to the controller.

These terms become effective on 1 January 2025.
